Safety. Never eat, taste, touch or handle any plant, fungus or animal because Trovario identified it. Identifications are probabilistic guesses from a machine-learning model and are wrong often enough to seriously harm you. Section 4.

By installing or using Trovario you agree to these terms. If you do not agree, do not use the app. If you are using a beta build through TestFlight, Apple's beta terms apply in addition to these.
Trovario is a game and a personal field guide. You photograph living things, a machine-learning service proposes an identification, and your collection fills up. It is built for curiosity and enjoyment.
It is not a scientific instrument, a foraging guide, a medical or veterinary resource, a pest-control tool, or a substitute for a qualified botanist, entomologist, mycologist or doctor.
Identifications are produced by a third-party machine-learning model. They are probabilistic and frequently wrong, including when the app displays high confidence. Many plants and fungi have deadly lookalikes that differ in details a photograph cannot capture. Many insects and arachnids are hazardous to handle.
Accordingly, you must not rely on Trovario:
Danger indicators shown in the app are general reference information about a species, not an assessment of the specimen in front of you, and their absence never means something is safe.
If you suspect poisoning or a serious sting or bite, contact emergency services or a poison control centre immediately. Do not consult this app.
You are also responsible for obeying the law where you are: respect protected species, protected sites, and private property, and do not pick, disturb or collect anything you are not permitted to.
You keep ownership of the photographs you take. You give us only the permission needed to run the app for you.
However, when you submit a photo for identification, it is sent to our identification provider, Kindwise (FlowerChecker s.r.o.). Under Kindwise's own terms, Kindwise obtains a non-exclusive, unlimited and irrevocable licence to that photograph, and may use it commercially, including to develop its services and to supply it to its other customers as a reference image. This is Kindwise's licence, not ours, and we cannot waive it for you. The privacy policy explains it in full. Do not submit photographs you are not willing to hand over on those terms, and keep people and identifying surroundings out of the frame.
You confirm that you have the right to submit the photographs you send, and that doing so does not infringe anyone else's rights.
Please do not: use the app for anything unlawful; attempt to extract, scrape or resell the species catalogue or reference imagery; submit content that is unlawful or infringing; interfere with, overload or reverse-engineer the app or the services behind it; or use automated means to generate identification requests.
Trovario is offered as-is and is currently in beta. Features may change, break or disappear, seasonal and catalogue data may be incomplete or inaccurate, and we may suspend or discontinue the service. Identification depends on a third-party provider whose availability we do not control.
Your catches are stored only on your device and are not backed up by us. Deleting the app deletes them permanently.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are not affected.
Subject to that, and to the fullest extent permitted by law: the app is provided without warranties of accuracy, completeness or fitness for a particular purpose; we are not liable for loss or damage arising from reliance on an identification, from loss of your catch data, or from unavailability of the service; and we are not liable for indirect or consequential loss.
The app, its name, its artwork and its curated catalogue are ours or our licensors'. Reference photographs are used under their respective licences, with attribution recorded in the app. You get a personal, non-transferable, revocable licence to use the app for its intended purpose.
You can end them at any time by deleting the app. We may suspend access if you materially breach these terms.
These terms are governed by the law of New Mexico. If you are a consumer resident in the EU or UK, you keep the protection of the mandatory consumer law of your country of residence and may bring proceedings there.
We may update these terms; the version and date above will change, and material changes will be surfaced in the app.
